When I try to copy a file to or from my NAS or between shares on my NAS I often get this error.
The operation can’t be completed because the item XXX is in use.

The whole files copies but at the very end I get this error. If I try to copy again i might work

I never had this problem in Lion or Mountain Lion. Its a Mavericks error.

I use SMB shares on my NAS

Anyone else having the same problem.
 
Same problem here! Using a linux NAS with SMB mounts on OS X Mavericks and keep getting that error. I get the problem copying both TO and FROM the server. New to the Mavericks upgrade. Any solution would be helpful!

I did a workaround. Turned on AFP on my NAS. That works but I would like to find a solution so I can go back to using SMB.
 
I have this issue too with Mavericks 10.9.2 and an SMB share via WDLIVE media player. I think the new SMB is naff. I can't connect to the server component on my mac reliably from anything either so I'm trying to replace it with SAMBA though it has to be command-line managed presently as SMBup doesn't seem to work properly with Mavericks for me. I've yet to get it working properly though as the service won't start, complaining thusly:

bind failed on port 445 socket_addr = 0.0.0.0.
Error = Address already in use
open_sockets_smbd: No sockets available to bind to.
