Magic Mouse stopped working

My new MM resets itself or goes to sleep mode whenever I use 3 or 4 fingers on it, even in Win 7. The indicator light goes off, no respond for moving or clicking but it's still connected via bluetooth. I tested it with several software like BetterTouchTool, MagicPref, Seamouse etc... but it keeps stop working so I think this is not software/hackintosh issue. I also googled it and found (until now) no one have the same problem. Have any of you had this problem? Should I bring it back to the store to get another one?

Does the MM have replaceable batteries? Have you tried changing them?

Yes it has, but it's a brand new mouse and the battery is fully charged 100%. I think it's hardware problems...
