Hi Kiwi,

Yes Intel fixed the problem and I got it back but after installing everything again I find out that the bios was updated to 5200 and Intel placed a supervisor password on the bios so that I can't change my settings. So I tried clearing the cmos and restore to default but that didn't do anything so I contacted the company AGAIN and they told me to send it back again and then they send me a new one.

And today I get my new one:) Hopefully this was the last time.

Okay checked the board, and find out that when I fully reset it to factory settings it flashes itself back to bios 0048 and not to 0038 so that means I can't update it with a patched 0051 or 0052 bios..

So hopefully there is a way to install os X without patching the bios.

No, that should be no problem. Just downgrade to an unpatched 0038 BIOS and then flash your patched 0051. That worked for me.
