Defective Gigabyte GA-Z77X-UD5H?

After my build, turned on the power to get an Error 51 on my MOBO i.e. memory installation error occurred, stuck in a boot loop, and no signal to my monitor. I had a stick in the 1 and 3 DDR ports. Tried to switch slots and boot out of slots 2 and 4 to the same results. I tried the same thing, but with one stick in each port one by one. Received the same error in ports 1,2, and 3, however port 4 took me to the BIOS screen. Is this safe to assume that this is a defective motherboard? I do not really want to continue this build until I am capable of using both sticks of RAM and being capable of a future upgrade.​
 
have u tried clearing the cmos? unplug power cord wait 10secs then clear cmos leave the jumper on for 1min
 
Tried, nothing. Ports 2 and 4 work fine now. Just 1 and 3 still give me an error which leaves me with limited memory upgradeability.
 
i would clear the the cmos again this time take out the battery and leave it on clear overnight if this does work i would return the mobo
